PLP Rewards Club - Terms & Conditions
These terms and conditions are applicable to the loyalty programme
known as the PLP Rewards Club ("PLP"). The PLP Rewards
Club has been established and is owned by Pacific Lifestyle
Property Pty Ltd (ACN 120 746 876)
Interpretation
Us/We/Our means Pacific Lifestyle Property Pty Ltd (ACN 120
746 876)
If you apply to become, or become a member of PLP or use any
of the benefits arising from PLP including claiming any award
you will be taken as having been bound by these terms and
conditions and will be taken to have given the privacy consents
referred to in these terms.
An electronic communication from Us will satisfy any requirement
for a written communication. Any electronic communication
We send you will be taken to be received by you on the next
business day after we send it, provided we have sent it to
the email address you have provided to Us. Where we must give
you notice of any matter concerning PLP, We will be taken
to have given you that notice if We send you a communication
(whether by email, post or otherwise) to the address (including
email address) as notified by you from time to time. An electronic
communication you send to Us will be taken to be received
by Us on the next business day after you send it, provided
you send it on the contact form available on our website www.PLProperty.com.au
You can become a Member of PLP if you are an individual resident
in any country in the world (corporations are not eligible),
aged 18 years or above, are not an employee of a real estate
agency in Australia and meet any eligibility criteria set
out in these terms (and any others posted on www.PLProperty.com.au
from time to time)
The criteria for Membership include completing an enrolment
in the form we require. For security reasons applicants for
Membership may be required to provide information including
personally identifying information about themselves at any
time We require. For online enrolment, once your application
has been processed successfully We will send you a confirmation
e-mail.
Applicants for Membership will not be charged an enrolment
fee if they apply for Membership online at www.PLProperty.com.au
You may terminate your Membership at any time by giving written
notice to Us. We may, acting reasonably, terminate or suspend
your Membership at any time if We believe that you have acted
inappropriately. Inappropriate conduct includes (but is not
limited to): fraud or defaming Us
To the extent permitted by law, (which may impose non-excludable
obligations, terms, conditions, warranties and consumer rights
into the supply and/or sale of goods by us), you agree that
We will not be liable for any loss or damage whatsoever which
you or anyone else may suffer as a result of any termination
or suspension of your Membership.
To the extent permitted by law, (which may impose non-excludable
obligations, terms, conditions, warranties and consumer rights
into the supply and/or sale of goods by Us), we are not liable
to you for any monetary loss or damage. Where permitted by
law to do so, we exclude liability to you for any direct or
indirect loss, damage or expense regardless of whether the
same arose from negligence, breach of contract or otherwise,
and regardless of whether we have any control over circumstances
giving rise to the claim or not. If we are liable to you in
any way, our liability will be limited to allocating to your
membership the Benefits which we consider is appropriate in
connection with which the relevant claim arose.
The allocation of benefits may be subject to taxes (including
GST), duties, levies, charges or other liabilities. You accept
sole responsibility for informing yourself of these, and for
such taxes, duties, levies, charges and other liabilities
W e do not guarantee that PLP will continue indefinitely,
or that it will always be managed and operated by Pacific
Lifestyle Property Pty Ltd. PLP may be terminated by us generally
or in regard to some aspects of it. We will give at least
30 days notice of termination of PLP (whether by email, post
or otherwise) to the address (including email address) as
notified by you from time to time, and by posting details
on www.PLProperty.com.au. You will be entitled to redeem any
benefits that you have accrued as at the date of termination
of PLP for a period of 30 days from when you receive notification
of the termination of PLP.
Where any law applying to this Agreement renders the following
provisions of this clause unenforceable, then, to that extent,
the following provisions of this clause do not apply
You agree that you have read, and consent to the Privacy Policy
available at our website www.PLProperty.com.au
PLP Status Levels
Members can only be one status level at any time.
Purchasing properties from Us count towards your status level.
The Benefits of status levels are posted on Our website www.PLProperty.com.au.
New members are allocated Silver status.
To achieve / maintain Platinum Status, members must purchase
a property from Pacific Lifestyle Property within 12 months
of their initial / preceding purchase. Each property purchase
must then be settled and/or all commission due and payable
to Us must be received by Us before you are eligible for Benefits
or upgrades to status levels.
If you do not meet the criteria to maintain your Platinum
status level you may be downgraded to Silver status level.
Redeeming Benefits
Accommodation benefits are provided at a leading 5 star hotel
on the Gold Coast or in your nearest capital city. Seasonal
venues will be decided by Us. Accommodation will need to be
taken within 3 months of your property settlement. We will
liase with you to determine a suitable date prior to booking
your accommodation.
Benefits may be revised by Us as we deem necessary from time
to time. We will give you 30 days written notice of any material
detrimental changes to these terms and conditions and also
post the changes at www.PLProperty.com.au We may not give
you notice of other changes. It is your responsibility to
keep abreast of any changes or current features to PLP. The
terms which apply to any accumulated benefits are those in
force on the date they are issued and the terms applying to
the redemption of benefits are those applying at the date
of redemption. If there is inconsistency, the terms applying
at the date of redemption prevail.
